Terms of Service

1. Acceptance of Terms

By accessing or using RxText ("the Service"), you agree to be bound by these Terms of Service. The Service is operated by RxText and is intended for use by licensed pharmacies and their authorized staff.

2. Service Description

RxText provides HIPAA-compliant two-way SMS messaging and payment collection tools for independent pharmacies. The Service allows pharmacies to communicate with patients via text message and collect copayments and balances through secure payment links powered by Stripe Connect.

3. Account Requirements

  • You must be a licensed pharmacy or authorized representative to use the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You must execute a Business Associate Agreement (BAA) before transmitting PHI.
  • Each staff member must have their own account - shared accounts are prohibited.

4. HIPAA and Compliance

You acknowledge that the Service is designed to transmit Protected Health Information (PHI) and agree to comply with all applicable HIPAA regulations. You are responsible for obtaining patient consent before sending SMS messages. The Service enforces consent tracking and will block messages to patients who have opted out.

5. Payments and Fees

  • Monthly subscription fees are billed in advance based on your selected plan.
  • Payment processing through Stripe Connect incurs a platform fee of 2.9% + $0.30 per transaction.
  • SMS message costs are billed based on volume and carrier rates.
  • All fees are non-refundable unless otherwise stated.

6. Acceptable Use

You agree not to:

  • Send unsolicited messages or spam to patients.
  • Use the Service for any purpose other than legitimate pharmacy communications.
  • Attempt to circumvent consent tracking or opt-out mechanisms.
  • Share, sell, or otherwise distribute patient data obtained through the Service.
  • Violate any applicable federal, state, or local laws including TCPA and HIPAA.

7. Data Ownership

You retain ownership of all patient data entered into the Service. RxText acts as a Business Associate and processes data solely on your behalf. You may export your data at any time through the compliance dashboard. Upon account termination, data is retained for 6 years per HIPAA requirements, then permanently deleted.

8. Limitation of Liability

RxText is provided "as is" without warranties of any kind. We are not liable for SMS delivery failures caused by carrier issues, patient device settings, or network outages. Our total liability is limited to the fees paid in the 12 months preceding any claim.

9. Termination

Either party may terminate service with 30 days written notice. We reserve the right to suspend accounts that violate these terms or applicable law. Upon termination, your access to the dashboard will be revoked but data export will remain available for 90 days.
